Car and Truck Accident Attorney for Western North Carolina

If you were hurt in a crash anywhere in Western North Carolina, I can come to you, all the way to the far western counties. We talk first by phone or video. After that I meet you in person where you are, and we decide in that meeting whether to work together.

Roads in the mountains can close, and many of the two-lane highways carry truck limits of their own.

This page covers the corridors through these counties, what happens when the other driver came from Tennessee, the two designated trauma centers in Asheville and Hendersonville, how Troop G and the Asheville police handle crash reports, and the first conversation when you live far from Graham.

01

I-40 at the Tennessee line, Future I-26 and the mountain truck rules

I-40 and I-26 from the state line

I-40 enters North Carolina from Tennessee in Haywood County and continues east through Buncombe. Heavy trucks are barred from its leftmost lane on stretches in both counties, including from the Tennessee line to near U.S. 276.

I-26 runs from the Tennessee line in Madison County through Buncombe and Henderson to Polk County near Saluda, and a 2023 NCDOT release called the Madison County stretch Future Interstate 26. In Madison County, heavy trucks are kept out of the I-26 left lane from the Tennessee line to near Exit 9.

NCDOT is widening about 16.9 miles of I-26 from U.S. 64 (Exit 49) in Hendersonville to the I-40/I-240 interchange. In 2025 NCDOT called the Henderson County section functionally complete, and work in Buncombe County is still underway.

Two-lane mountain highways with truck limits

Off the interstates, NCDOT's truck rules send trucks into truck information stations on N.C. 226 in Mitchell County and on U.S. 64 in Macon and Clay counties. In Macon the rule says the station is there so drivers can be advised of steep grade conditions.

RoadCountiesNCDOT truck rule

U.S. 19Jackson and into SwainThrough trucks with trailers longer than 30 feet barred

U.S. 64Macon and ClayTruck information station

In Watauga County, NCDOT has proposed widening U.S. 421 and U.S. 321 west of Boone.

When a truck was involved on a mountain road, the first questions are whether a vehicle of that size was allowed on that road and whether the driver stopped where the grade rules required.

02

Can a Tennessee driver who went home be served here?

A Tennessee address does not keep a driver out of a North Carolina courtroom. Under G.S. 1-105, a nonresident who drives on a North Carolina highway is treated as having appointed the Commissioner of Motor Vehicles to receive the lawsuit papers for a collision here, and that service has the same force as handing them to the driver personally.

Papers to the Commissioner

Service is made by leaving a copy of the process with the Commissioner of Motor Vehicles, along with a $20 fee.

Notice by mail

Notice and a copy then go to the driver by certified or registered mail, and the return receipt is evidence of the delivery date.

Exception. If the driver has died before the case begins, the same rule reaches the driver's executor or administrator, served in the same manner and on the same notice.

03

Mission in Asheville and Pardee in Hendersonville on the state list

The North Carolina Office of Emergency Medical Services lists two designated trauma centers in the mountain counties. HCA Mission Hospitals in Asheville appears under Level I, first designated in 1995, and UNC Health Pardee in Hendersonville appears under Level III, with an initial designation in 2026.

The same OEMS page says a center is reviewed with a site visit for renewal three years after its initial designation, and every four years after that.

The list shows where the designated centers are. It does not decide where any one injured person in Boone or Murphy is taken.

Troop G, town limits and the Asheville police crash records

Sixteen of the nineteen counties on this page belong to the State Highway Patrol's Troop G in Asheville. Watauga, Ashe and Alleghany belong to Troop F in Newton.

In Rutherfordton, town limits decide which agency writes the report. The town says its police investigate crashes inside town limits, and the Highway Patrol will typically investigate any crash outside municipal boundaries.

Work out who investigated

Inside a town, look to the town police. Outside town limits, look to the Patrol.

Pull the agency copy

The Asheville Police Department puts most crash reports from 2003 forward on its Police to Citizen tool, searchable by case number or by date and location, and takes mail requests at PO Box 7148, Asheville, NC 28802, with a stamped envelope addressed to yourself. For a Patrol crash, the NCDPS Collision Information search covers reports since May 16, 2013.

Get the certified report

Certified crash reports come from the NCDMV under G.S. 20-42, according to the Patrol's public records page.

Rutherfordton runs an online crash report database of its own for people involved in a crash, their attorneys and their insurers. The town says that electronic copy is not a certified report, and points anyone who needs a certified one to the NCDMV.

Meeting in Boone or Murphy after the first call

Distance is the reason this offer exists. After a first phone or video conversation, I meet you in person in Boone or Murphy or wherever you are in North Carolina, and we decide in that meeting whether to work together.

Distance is the reason this offer exists.

If you were visiting and have already gone home to another state, the phone and video conversation works the same from there. How it works lays out each step.
