Injury Attorney for Northeast North Carolina and the Outer Banks

If you were hurt in a crash anywhere in Northeast North Carolina or on the Outer Banks, I can come to you, whether you live here or were on vacation. We talk first by phone or video. Then I meet you in person where you are, and we decide in that meeting whether to work together.

In this corner of the state, US highways and long bridges do the work that interstates do elsewhere.

This page covers those roads, what changes when everyone in the crash was from out of state, that the state trauma center list names no hospital in these twelve counties, how Troop A and the Nags Head police handle crash reports, and the first conversation.

01

U.S. 17 toward Norfolk, the Wright Memorial Bridge and U.S. 64

U.S. 17 and the Future I-87 study

U.S. 17 is the long-distance road. NCDOT has studied upgrading it to Future I-87 from U.S. 64 in Williamston to the Virginia line through Bertie, Chowan, Perquimans, Pasquotank and Camden counties, and it describes U.S. 17 as the route that speeds agricultural products to the Port of Virginia in Norfolk. The corridor map in that study runs past Windsor, Edenton, Hertford and Elizabeth City.

One highway crossing of Currituck Sound

U.S. 158 crosses Currituck Sound on the Wright Memorial Bridge from the southern end of Currituck County into Dare County. NCDOT calls it the only highway crossing of the sound and reports summer congestion on U.S. 158 and N.C. 12.

NCDOT reports that hurricane evacuation clearance times on U.S. 158 and N.C. 168 far exceed the state standard, and it describes a proposed Mid-Currituck Bridge that would create a second crossing of the sound.

U.S. 64 over the Alligator River

Farther south, U.S. 64 runs from Columbia in Tyrrell County to U.S. 264 near Manns Harbor in Dare County and crosses the Alligator River on the Lindsay C. Warren Bridge. NCDOT names that road a primary evacuation route for the Outer Banks, and its widening remains unfunded.

Visitors on unfamiliar roads share N.C. 12 and U.S. 158 with people who live and work here. When summer congestion backs up U.S. 158 and N.C. 12, stop-and-go traffic follows, and in those rear-end cases following distance is the first question I ask about.

Can two out-of-state families file their crash case here?

A crash between two families from other states can still be filed in North Carolina. Under G.S. 1-82, when no party lives here, the plaintiff names the county in the summons and complaint, and the court keeps its power to change the place of trial.

Nobody lives in North Carolina

The plaintiff picks the county in the summons and complaint, subject to the court's power to move the trial.

The other driver lives here

The county where that driver lives is a proper place for the case, even when you live in Virginia or Ohio.

Serving a driver who has gone home to another state

Service on a driver who has gone home runs through the Commissioner of Motor Vehicles under G.S. 1-105, and the Western North Carolina page walks through it. When the driver refuses the certified or registered letter, G.S. 1-105 treats service as complete on the date of refusal shown by the postal notation.

03

The twelve northeast counties have no hospital on the trauma list

The North Carolina Office of Emergency Medical Services list of designated trauma centers names no hospital in the twelve counties on this page. The eastern centers it does name are in Greenville, Wilmington and Camp Lejeune.

A North Carolina list leaves out hospitals across the Virginia line. Neither this table nor the list says where a person hurt on the Outer Banks is taken.

Troop A, the Nags Head report form and the NCDMV copy

All twelve counties on this page fall under the State Highway Patrol's Troop A, headquartered at 4651-A North Creek Dr. in Greenville. Its first four Patrol districts cover them.

Troop A Patrol districtCounties
District IDare and Currituck, with a substation in Currituck
District IIHertford, Gates and Bertie
District IIIPasquotank, Chowan, Perquimans and Camden
District IVBeaufort, Washington, Tyrrell and Hyde

In a beach town with its own police, that department most likely responded. Nags Head takes requests through its online Accident or Incident Report and Payment Form, by phone at 252-441-6386 or at 5401 S Croatan Highway, charges $5 and says copies are usually ready five business days after the incident.

Parking lots get their own rule. In the same NCDPS interview, the Patrol said a reportable collision in a parking lot still goes to law enforcement, and whether the lot sits inside a town decides which agency responds.

A driver who hits a parked or unattended vehicle on a North Carolina highway reports it to the vehicle's owner within 48 hours under G.S. 20-166.1(c), with the time, date and place, the driver's name, address and license number, and the plate number.

Pin down the agency

Outside town limits a crash typically falls to the Patrol, a Patrol first sergeant said in an NCDPS interview.

Request the agency copy

Use the town's form, or search the NCDPS Collision Information page for a Patrol crash, which can take up to 48 hours to appear.

Ask NCDMV for the certified report

A visitor already home can mail form TR-67A, and the DMV asks for ten business days on a mailed request.

Meeting at an Edenton home or a Nags Head rental cottage

The first conversation is by phone or video, and it works the same whether you are in Elizabeth City or already back home in another state. When you are in North Carolina, I come to you at your home in Edenton or a rental cottage in Nags Head.
